Proposed New Local Law and Local Law Amendments
Consultation has concluded
Council has recommended a collection of draft new local laws and local law amendments for community consultation. They are among the first changes to be considered since the adoption of an entire new suite of local laws in 2015 and span a number of topics.

Have your say on pets, regulated parking, shipping containers, shopping trolleys and other proposed changes

While some of the proposed amendments are purely administrative, others will have a direct impact on various members of our community. Below is a list of proposed changes that are most likely to be of public interest, with links to the proposed amendments or law and topic specific fact sheets.
New Subordinate Local Law 1.19 (Placement of Shipping Containers, Railway Carriages and Other Objects on Land) 2018

This proposed new subordinate local law seeks to regulate objects not defined as a building or structure under the Building Act 1975.
The addition of this subordinate local law requires enabling amendment to the governing Local Law 1, to provide definitions as well as the power to remove an unlawful shipping container, railway carriage, or other object where no action is taken by a person following enforcement.
Why? To ensure a container, railway carriage of other object is located in accordance with appropriate zoning, design, dimension and appearance conditions.
Possible impact:
- You may have to obtain approval for location of a shipping containers or railway carriages on your land.
- You may be required to keep the container or carriage in good order and condition or to remove the container or carriage by a specified date.
- It will be prohibited to place certain objects on vacant land.

Subordinate Local Law No. 1.5 (Keeping of Animals) 2015
There are two proposed amendments of note to this subordinate local law, both designed to bring the Redlands in line with neighbouring councils:
- To include a fourth dog permit with criteria.
Find changes in Schedule 1:Item 1 (2) (c) and Item 6 (2) and (3) of proposed Subordinate Local Law No.1.5
Possible impact:- You would be able to apply to keep four dogs if your property is 6000 m2 or larger.
- To remove two current requirements needed for a third animal permit

Possible impact:- Compassionate grounds would not need to be met in your application to keep an extra dog or cat on your property.
- You wouldn’t need your neighbours’ permission to apply to keep an extra dog or cat.
- To include a fourth dog permit with criteria.

Local Law No. 2 (Animal Management) 2015
There are two proposed amendments of note to this local law:
- To exempt cats from wearing registration tags in certain circumstances, for the safety of the animals.
Find changes in Section 49A (2) of proposed Local Law No. 2 - To update the criteria for viewing the register of impounded animals, for privacy reason.
Find changes in Section 31 (6) of proposed Local Law No 2
Possible impact:- You would only be able to view items on the register relating to your own animal.
- To exempt cats from wearing registration tags in certain circumstances, for the safety of the animals.

Subordinate Local Law No. 2 (Animal Management) 2015
An amendment is proposed to define the criteria for a dog enclosure, specifying a fence as a physical barrier, for community safety reasons.

Possible impacts:
- You would need to ensure your dog enclosure meets the criteria set out for a physical barrier.
- A house would not be considered an enclosure.

Local Law 3 (Community and Environmental Management) 2015
There are two proposed amendments of note to this local law:
- To amend criteria for native bird feeding on residential properties, so it doesn’t cause a nuisance (such as noise, waste, odour and property damage) to adjoining or nearby land.
Find changes in Part 8 Section 23 of proposed LL3
Possible impact:- You could be subject to a penalty (up to 50 unit points)
- To regulate the removal of shopping trolleys from retail precincts, for amenity, environmental and safety reasons.
Find changes in Part 7 Sections 21-22 of proposed LL3
Possible impacts:- While retailers remain responsible for trolley retrieval, individuals could be fined for removing a trolley from the retail precinct.
- To amend criteria for native bird feeding on residential properties, so it doesn’t cause a nuisance (such as noise, waste, odour and property damage) to adjoining or nearby land.
Subordinate Local Law 4 (Local Government Controlled Areas, Facilities and Roads) 2015
This proposed amendment seeks to allow fishing from bridges and culverts in Redland City unless authorised signage prohibits it.

Subordinate Local Law 5 (Parking) 2015
This proposed amendment seeks to add regulated off-street parking areas throughout the City including:
- Cleveland - Map 2F (iv) and Map 2G
- North Stradbroke Island - Map 4A (ii) and Map 4C (i) & (ii)
- Redland Bay - Map 5A (iv) and Map 5B
- Russell Island - Map 6B (i) & (ii)
- Victoria Point - Map 7A (ii)
Find changes in proposed SLL5 Schedule 2 Part 1 Areas declared regulated off- street parking and Part 2 Maps of off-street regulated parking.
Possible impacts:
- To provide some new regulated parking areas and to designate permitted parking time or limitations on parking, indicated on official traffic signs installed in the areas.
- Under regulated parking areas, Council may impose certain penalties for minor traffic offences relating to stopping and parking of vehicles contrary to signed directions.

- Provide the grounds on which you are making your submission (that is, whether you agree or disagree with the amendments)
- Provide reasons and facts to support the grounds of your submission.

All submissions will be considered before the final report on the proposed new laws and amendments is presented to Council for possible adoption.
